Terms & Conditions

These terms govern the arrangements between Wargakita and families or individuals who enquire about, or engage, our at-home companionship and coordination services. Please read them carefully before proceeding.

Definitions

In these Terms & Conditions, the following terms carry the meanings assigned below unless context requires otherwise.

  • "Agreement" — these Terms & Conditions together with any written arrangement confirmation issued by Wargakita.
  • "We / Us / Our" — Wargakita, a companionship and family coordination service provider registered and operating in Kuala Lumpur, Malaysia.
  • "Service" — the at-home companionship, family coordination, and caregiver guidance arrangements described on our website and in any written confirmation.
  • "User" or "You" — any individual or family representative who contacts Wargakita, visits this website, or enters into an arrangement with us.
  • "Content" — all text, written updates, printed guides, session recordings, and other materials produced or shared in connection with the Service.
  • "Arrangement Period" — the agreed duration during which a specific service is active, as set out in written confirmation.

Acceptance of Terms

By submitting an enquiry form, signing a written arrangement confirmation, or making a payment to Wargakita, you confirm that you have read, understood, and agree to be bound by this Agreement.

You must be at least 18 years of age and have full legal capacity to enter into a binding agreement under Malaysian law. If you are acting on behalf of a family or household, you confirm that you are authorised to do so.

Continued use of this website after any published update to these Terms constitutes acceptance of the revised version.

Service Description

Wargakita offers three at-home support arrangements for older relatives and their families in Kuala Lumpur and the Klang Valley:

  • Regular Check-in & Family Updates — scheduled friendly phone or in-person check-ins with short written summaries shared with the family.
  • Companionship Visit Coordination — arranging regular visits for conversation, shared activities, and gentle walks.
  • Caregiver Guidance Workshops — small-group or one-to-one sessions for family members on daily routines, home setups, and warm communication.

All services are described as general companionship, household coordination, and informational guidance only. Nothing within our Service constitutes regulated professional activity including, without limitation, clinical care, occupational therapy, nursing, or social work.

Service availability is subject to scheduling capacity in the Kuala Lumpur and Klang Valley area. We do not currently offer services outside this region.

User Responsibilities

When engaging with Wargakita, you agree to:

  • Provide accurate and complete information at the time of enquiry and throughout the arrangement period.
  • Inform us promptly of any changes to the older relative's circumstances that may affect the suitability or safety of the agreed arrangement.
  • Ensure a safe and respectful environment for any Wargakita representative visiting the home.
  • Not request or encourage Wargakita staff to perform activities outside the agreed scope, including regulated professional services.
  • Maintain confidentiality regarding any personal information shared by Wargakita staff or companions during visits.

You must not use this website or our services in any way that is unlawful, harmful to others, or contrary to these Terms.

Intellectual Property

All content on this website — including text, design elements, printed guides, and session materials — is the property of Wargakita or its licensors and is protected under Malaysian copyright law.

We grant you a limited, non-exclusive, non-transferable licence to access and use materials provided as part of your arrangement for personal, non-commercial purposes only. This licence does not permit reproduction, redistribution, or sharing of materials with third parties without our written consent.

Any printed guides or session recordings provided as part of the Caregiver Guidance Workshop arrangement are for your household's personal use and may not be reproduced or published without permission.

Payment Terms

All fees are quoted and payable in Malaysian Ringgit (RM). Current pricing for each arrangement is set out on our website and in your written arrangement confirmation.

  • Payment timing: Full payment or an agreed deposit is due before the arrangement period begins, as specified in your written confirmation.
  • Payment methods: Bank transfer and e-wallet options as communicated during confirmation. We do not accept cash payments.
  • Cancellation by You: If you cancel seven (7) or more days before the arrangement start date, a refund of the deposit minus an administration fee of RM 150 will be issued within 14 business days. Cancellations with fewer than seven days' notice are non-refundable.
  • Cancellation by Us: If we are unable to deliver the agreed arrangement, you will receive a full refund within 14 business days.

Prices may change between arrangement periods. Any change will be communicated in writing at least 30 days before it takes effect.

Service Delivery Terms

The scope, schedule, and duration of each arrangement are set out in your written confirmation. We will make reasonable efforts to follow the agreed schedule, but occasional rescheduling may be necessary due to circumstances outside our control.

  • Schedule changes: We will provide at least 24 hours' notice of any change to an agreed visit or session. You may request a reschedule with the same notice period.
  • Scope changes: Any addition to or reduction of agreed services must be confirmed in writing by both parties.
  • Confidentiality: Written updates and family communication shared during the arrangement are treated as confidential and not disclosed to third parties without your consent, except as required by law.

We do not sub-contract arrangements to third-party agencies without your prior written consent.

Disclaimers

Wargakita provides its services on an "as available" basis. While we take care to deliver arrangements to a consistent standard, we do not warrant that the Service will be uninterrupted or entirely free from imperfection.

Nothing in our Service, website content, printed materials, or staff communication constitutes professional advice of any kind — including medical, legal, financial, or occupational advice. Families are encouraged to consult qualified professionals for any regulated concern.

We make no representation that any particular outcome will result from engaging our arrangements. Individual experiences vary depending on the older relative's circumstances and the family's situation.

Limitation of Liability

To the fullest extent permitted under Malaysian law, Wargakita's total liability arising out of or in connection with any arrangement shall not exceed the total amount paid by you for that specific arrangement period.

We shall not be liable for indirect, incidental, or consequential loss or damage, including loss of business, loss of anticipated outcomes, or distress caused by circumstances outside our reasonable control (force majeure), such as severe weather, public emergencies, or infrastructure failure.

Nothing in this section limits liability for death or personal injury resulting from our negligence, or for any other liability that cannot be excluded under applicable Malaysian consumer protection law.

Indemnification

You agree to indemnify and hold harmless Wargakita, its coordinators, and representatives from any claims, losses, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms & Conditions.
  • False or misleading information provided to us during enquiry or the arrangement period.
  • Any harm caused by your actions or those of your household members toward Wargakita staff or companions.

Termination

Either party may end an active arrangement by giving seven (7) days' written notice. Notice should be sent by email to [email protected].

Wargakita may terminate an arrangement with immediate effect if you breach these Terms in a way that places our staff or companions at risk, or where continued delivery is not reasonably practicable.

Clauses relating to intellectual property, payment obligations incurred before termination, disclaimers, limitation of liability, and dispute resolution survive termination of this Agreement.

Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

Before commencing formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct written communication. If no resolution is reached within 21 days, either party may pursue formal dispute resolution.

Where both parties agree, disputes may be referred to mediation through the Malaysian Mediation Centre before litigation is initiated.

General Provisions

  • Entire Agreement: This Agreement, together with any written arrangement confirmation, constitutes the entire agreement between the parties regarding the Service and supersedes all prior discussions.
  • Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision on any other occasion.
  • Assignment: You may not assign your rights under this Agreement without our prior written consent. We may assign our obligations to a successor entity with written notice to you.
  • Notices: Written notices should be sent by email to [email protected] or by post to our registered address below.

Changes to Terms

We may update these Terms & Conditions from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will send a notice to the email address associated with your active arrangement at least 14 days before the change takes effect.

Your continued use of our Service after a change becomes effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may terminate your arrangement in accordance with Section 11.
